Will Smith Hit With Sexual Harassment Lawsuit From Tour Violinist

Will Smith is facing a lawsuit from a musician who worked on his recent tour. The claims were reported by Variety, which reviewed the legal filing earlier this week.

The person bringing the lawsuit is violinist Brian King Joseph. He is known for appearing on “America’s Got Talent.” In the complaint, Joseph names Smith and Treyball Studios Management.

He accuses Smith of s**** harassment, retaliation, and wrongful termination connected to the “Based on a True Story: 2025 Tour.”

According to the lawsuit, Joseph was first hired in November 2024 to perform at a show in San Diego. After that performance, he says Smith asked him to join the 2025 tour and also discussed having him play on a future album. Joseph claims that over time, Smith made comments that crossed professional lines, including saying “you and I have such a special connection, that I don’t have with anyone else.”

Joseph joined the tour in March 2025, starting with a stop in Las Vegas. Hotel rooms were arranged for the band and crew. The lawsuit states that Joseph’s bag, which had his hotel key inside, went missing for several hours. It was later returned by management. He claims that tour staff were the only people who could access his room.

That same night, Joseph says he found signs that someone had entered his room without permission. He alleges that items were left behind, including wipes, a bottle of HIV medication with another person’s name on it, and a handwritten note. The note said, “Brian, I’ll be back no later [sic] 5:30, just us (drawn heart), Stone F.” Joseph says he took this as a warning that someone planned to return to his room for s***** activity.

After finding the items, Joseph contacted hotel security, informed Smith’s team, and reported the situation through a non-emergency police call. The lawsuit claims that instead of being supported, Joseph was later criticized by management. He says he was accused of making up the incident and was fired from the tour only days later.

The lawsuit also states that Joseph suffered emotional distress after losing the job. He claims he developed PTSD and lost income because of the termination. He is asking a jury to decide damages related to s***** harassment, retaliation, and wrongful termination.
